Website terms of use

NHS Blood and Transplant ("NHSBT") is a special health authority within the NHS that manages the National Blood Service, Bio Products Laboratory and Organ Donation and Transplantation.

Use of the Wall of Life website (the "Website") at www.walloflife.org.uk is subject to these terms of use. Any person who does not accept these terms of use is not authorised to use or to continue to use the Website.

NHSBT may amend these terms of use at any time and any revised version will be effective immediately that it is displayed on the Website.

In the event of any comments or questions concerning these terms of use, users should contact NHSBT as indicated under "Contact" below.

Intellectual property rights of NHSBT

NHSBT owns or is licensed to use all intellectual property rights in and to the Website and all technical infrastructure relating to it. Except as expressly set out in the Website, users shall not acquire or accrue any rights in and to the Website or to any material downloaded from the Website.

Wall of Life is a trade mark of NHSBT. Users acknowledge the reputation of the trade mark and that unlicensed use may cause unquantifiable damage to NHSBT.

Access to and use of the Website

In accessing any part of the Website, each user agrees:

  • not to use the Website in any way that disrupts, interferes with or restricts the use of the Website by other users;
  • not to upload, display or transmit any materials or information through the Website that are false, offensive, defamatory, blasphemous, threatening, obscene, unlawful or which infringe the rights of any other person anywhere in the world;
  • to upload images and personal information only in accordance with the instructions to users provided in the Website;
  • not to upload images of or information about any person other than of the user himself or herself except where that other person is capable of giving consent and expressly does so;
  • not to reverse engineer, decompile, copy or adapt any software or other code or script forming part of the Website or attempt to transmit to or via the Website any information that contains a virus, worm, Trojan horse or other harmful or disruptive component; and
  • not to change, modify, delete, interfere with or misuse data contained on the Website and entered by or relating to any third party user of the Website.

Each user agrees that material contained in the Website may be downloaded, viewed and printed provided that:

  • the right is limited to private, non-commercial use;
  • the right is limited to information about the user himself or herself, except where the user is acting on behalf of another person with that person’s express permission in which case the information must pertain solely to that other person;
  • no trade mark, copyright or other proprietary notices contained in or appearing on such material are removed in whole or in part;
  • material contained in the Website may not otherwise be copied, reproduced or redistributed in whole or in part without the prior written consent of NHSBT and in no event exploited for commercial gain; and

NHSBT reserves all other rights and users acknowledge that they may not make any other use of material contained in the Website without NHSBT’s prior written consent.

There is no upper or lower age restriction for people using the site or registering their organ donation wishes on the NHS Organ Donor Register (ODR). However anyone under 12 should discuss their organ donation wishes with a parent or guardian before joining the ODR and uploading their picture to the website.

Privacy policy

In order to join the Wall of Life you have to agree to these Terms and Conditions via the tick box on the website. You may then upload your image and name which will be stored securely by NHSBT’s authorised agent.

Your image and name on the Wall of Life will be viewable by members of the public who can zoom in on any part of the wall. If you choose to submit other personal information (home town, comment) with the photo entry, this will also be accessible to all. This personal information will also be stored by NHSBT’s authorised agent in a secure environment. The submission of this personal data (home town and/or comment) is completely optional.

NHSBT will not use your personal information for any other purpose and does not link it to any other data held by NHSBT which might identify or provide information about you as an individual. NHSBT may use your image as part of the whole Wall of Life image for publicity purposes.

To upload an image to the Wall of Life, we will require your email address so that we can notify you when your image has been uploaded and send you a unique URL for viewing your image on the wall which you can then pass on to friends and family if you wish. You will also be supplied with a link allowing you to remove yourself from the wall at any time. You can also remove yourself from the wall by using the ’Contact Us’ link on the website. Your email address will be processed in accordance with the Data Protection Act 1998.It will not be displayed on the Website nor released to any third party without your prior consent.

Before your image and personal information appear on the Wall of Life, they will only be accessible by NHSBT staff or authorised agents who are responsible for administering and moderating the website. Any necessary transfer of data (ie between the secure data holding environment and the moderator) will be done securely.

NHSBT will display the Wall of Life decommissioning date on the website one month before the site is taken down from the internet. On that date NHSBT will destroy all personal data (pictures, email addresses, name, home town and/or comments) that has been submitted by site users.

The Website does refer to the NHSBT ODT website (www.organdonation.nhs.uk), but is separate from it and there is no exchange of information between the two sites. If you register with the NHSBT ODT website, you may be asked to provide personal information. In this case, please read the NHSBT ODT privacy and data collection policy which is posted there.

All images and information submitted will be moderated by NHSBT or its agents, and NHSBT reserves the right to exclude material from the Wall of Life if it considers it to be inappropriate, offensive etc. We will inform you of the reason for exclusion.

Images accepted for inclusion on the Wall of Life will usually be uploaded to the website within three days.

NHSBT uses cookies to record information about a user’s access to the Website. Users may view the website without the use of cookies by leaving the website, disabling cookies in their Internet browser and re-entering the site, but this may limit access to the Website or the functionality of certain web pages within the site.

Exclusions and limitations of liability

Owing to the nature of the Internet, NHSBT cannot guarantee that the Website or the websites to which it is linked will always be available to users. Users should ensure that they have appropriate protection against viruses and other security arrangements in place whilst using the Internet and the website.

Although every reasonable effort has been made to ensure that the information on the Website was accurate at the time of publication, it is subject to variation at any time without notice and NHSBT gives no warranty whatsoever that any such information will be accurate or complete at any particular time or at all.

This website and any information or other material contained in it are made available strictly on the basis that the user accepts it on an ’as is’ and ’as available’ basis. Where users of the Website rely on any information or other material contained in it, they do so entirely at their own risk and they accept that all warranties, conditions and undertakings, express or implied, whether by common law, statute, trade usage, course of dealings or otherwise in respect of the Website are excluded to the fullest extent permitted by law.

NHSBT excludes all liability whatever, to the fullest extent permitted by law, in respect of any loss or damage resulting or arising from any non-availability or use of the Website or of any other website linked to it, or from reliance on the contents of the Website or any material or content accessed through it.

Links

Users may create a hypertext link to the homepage of the Website at www.walloflife.org.uk provided such link is not used in a misleading, obscene, blasphemous or defamatory context. Users should not create links to any other page or file forming part of the Website.

Jurisdiction

This website has been designed and these terms of use shall be governed by and construed in accordance with English law. Any dispute arising out of the accessing or use of the Website shall be subject to the exclusive jurisdiction of the English courts.
